Read LessBeginning in the 2020-2021 School Year, All NPS & NPAs who serve California students must satisfy the following conditions:
All NPS & NPAs must provide AB 1172 Positive Behavior training to ALL staff who have contact or interaction with pupils during the schoolday
AB 1172 Positive Behavior Training must be provided within 30 days of employment to new staff and annually to all staff who have any contact or interaction with pupils during the schoolday.
AB 1172 Positive Behavior Training must be conducted by persons licensed or certified in fields related to the evidence-based practices and interventions being taught. Laura Mooiman, LCSW, is a licensed and certified professional in the area of evidence based practice
AB 1172 Positive Behavior Training must be consistent with the requirements of Article 5.2 (Section 49005) of Chapter 6 of Part 27, relating to pupil discipline, restraint & seclusion.
Content of the AB 1172 Positive Behavior Training must include: Positive behavioral intervention and supports. Collection, analysis, and use of data to inform, plan, and implement behavioral supports. How to understand and address challenging behaviors. Evidence-based strategies for reducing and replacing challenging behaviors. De-escalation techniques.
For purposes of fulfilling the AB 1772 requirements, a BCBA is not required by California. You can view the full California State Assembly Bill 1172 here. I have copied and pasted the applicable section below. (B) The training described in this paragraph shall be selected and conducted by the nonpublic, nonsectarian school or agency and shall satisfy all of the following conditions: (i) Be conducted by persons licensed or certified in fields related to the evidence-based practices and interventions being taught. (ii) Be taught in a manner consistent with the development and implementation of individualized education programs. (iii) Be consistent with the requirements of Article 5.2 (commencing with Section 49005) of Chapter 6 of Part 27, relating to pupil discipline.
Yes, the AB 1172 Positive Behavior Training needs to be completed once a year. Here is the section from AB 1172 that applies. *AB1172 - “(4) (A) (i) Commencing with the 2020–21 school year, documentation that the nonpublic, nonsectarian school or agency will train staff who will have contact or interaction with pupils during the school day in the use of evidence-based practices and interventions specific to the unique behavioral needs of the nonpublic, nonsectarian school or agency’s pupil population. The training shall be provided within 30 days of employment to new staff who have any contact or interaction with pupils during the school day, and annually to all staff who have any contact or interaction with pupils during the school day.”

Assembly bill 1172 was passed after a fatal accident at an NPS / NPA. The aim is to ensure any person working with California students as an NPS / NPA is trained in Positive Behavior to avoid the need for punishment and restraint
Positive Behavior training is to avoid the need for student punishment or restraint and improve the overall environment of the students.
